AI & Data Use Policy
1. Scope
This Policy applies when ArtTern or SM Marketing Management LLC uses artificial intelligence, machine learning, automated classification, recommendation, generative systems, or similar technologies in connection with the Website, artist development, brand development, marketing services, content tools, and platform development.
2. AI-Assisted Service Functions
ArtTern may use AI tools, with appropriate safeguards, to deliver or improve functions such as:
- translation, transcription, captioning, summarisation, spelling, and content drafting;
- profile categorisation, tagging, search, recommendations, and discovery;
- image resizing, background assistance, accessibility descriptions, quality checks, and content organisation;
- moderation, spam, fraud, duplicate, safety, and rights-risk detection;
- analytics, testing, customer support, and service improvement; and
- personalised brand or marketing suggestions requested by the artist.
These functions may process information needed to provide the selected service. At the point of use, we may provide additional details or obtain consent where required. Users must review AI-assisted outputs before publishing or relying on them.
3. Optional AI Development or Training
With separate, specific, recorded consent, ArtTern may use selected content to research, evaluate, fine-tune, train, or improve AI systems intended to support artist discovery, portfolio organisation, brand development, marketing recommendations, audience insights, content assistance, or other clearly described ArtTern features.
The separate consent must identify the selected scope. It should not be pre-ticked or hidden inside general Terms.

4. Purposes and Limits
Where you opt in, ArtTern may use the consented content only for the purposes disclosed in the consent and compatible ArtTern artist-development functions. We will not intentionally use consented content to:
- claim ownership or authorship of the artist’s work;
- sell private identity, contact, or billing data as a standalone dataset;
- make a solely automated decision that has a legal or similarly serious adverse effect without legally required safeguards;
- create deceptive imitations falsely attributed to the artist; or
- train on categories expressly excluded from the recorded consent.
5. Providers and Cross-Border Processing
AI and cloud providers may process data for ArtTern, including outside the UAE. Depending on the selected provider and feature, data may be transmitted to jurisdictions with different data-protection rules. We will use providers, contractual controls, security settings, and transfer safeguards appropriate to the service and applicable law. The specific consent or point-of-use notice should identify relevant provider categories and cross-border processing before consent is obtained.
6. Ownership and Output
Artists retain ownership of their original submitted content. Rights in AI output can be legally complex and may depend on the tool, provider terms, human contribution, source material, and jurisdiction. ArtTern does not guarantee that AI output is unique, protectable, non-infringing, accurate, or commercially suitable. Users must review outputs, obtain necessary rights, and avoid publishing deceptive or infringing results.
7. Human Review and Automated Decisions
Automated systems may assist with recommendations, ranking, moderation, or fraud signals, but ArtTern may use human review for consequential decisions. Where applicable law provides a right to object to a qualifying automated decision, you may request information and human review by emailing us.
8. Withdrawal, Objection, and Deletion
You may withdraw optional AI-development consent at any time by emailing support@arttern.com with the subject Withdraw AI Consent. Withdrawal:
- stops new consent-based use within a reasonable implementation period;
- does not make earlier lawful processing unlawful;
- does not necessarily allow removal of learned statistical parameters from a model already trained where the original person or content cannot reasonably be isolated, but we will apply legally required and technically reasonable measures;
- does not require deletion of records needed to prove consent, withdrawal, legal compliance, or defend rights; and
- does not automatically remove the public profile or end operational processing needed to provide the listing service.
You may separately request profile removal, correction, restriction, or exercise other privacy rights under the Privacy Policy.
9. Security and Risk Review
We use reasonable data-minimisation, access, contractual, security, and retention controls. Higher-risk AI projects may require a privacy or data-protection impact review before launch. No AI or internet system is completely risk-free.

ArtTern may retain evidence of the consent event, including the account, date and time, source form, IP address, policy and wording version, selected choices, and any withdrawal. This record protects both the user and ArtTern and supports legal compliance.
