1. About ArtTern
ArtTern is an online platform that helps artists, galleries, art suppliers, events, and art-related organisations increase visibility through listings, profiles, content, and marketing-related services.
2. Eligibility
You must be at least 18 years old or have permission from a parent or legal guardian to use ArtTern. By using the website, you confirm that the information you provide is accurate and lawful.
3. Account and Listing Responsibility
You are responsible for all information, images, links, text, and materials submitted through your account or listing. You must ensure that your content is accurate, lawful, non-misleading, and does not infringe the rights of any third party.
4. Listing Approval
ArtTern reserves the right to review, approve, reject, edit, suspend, or remove any listing or content at its sole discretion, especially where the content is incomplete, misleading, unlawful, inappropriate, duplicated, promotional in a harmful way, or inconsistent with our platform standards.
5. User Content
By submitting content to ArtTern, including images, text, biography, artist statement, CV, videos, links, logos, and artwork images, you grant ArtTern a non-exclusive, worldwide, royalty-free licence to display, reproduce, resize, format, publish, promote, and distribute such content for the purpose of operating and promoting the platform and your listing.
6. Intellectual Property
You retain ownership of your original content and artwork. You confirm that you own or have the necessary rights and permissions to upload and publish all content submitted to ArtTern.
7. Prohibited Content
You must not upload, publish, or submit content that:
- Violates UAE laws or any applicable laws
- Contains false, misleading, defamatory, offensive, hateful, abusive, threatening, or unlawful material
- Impersonates another person, artist, gallery, business, institution, or government entity
- Infringes copyright, trademark, privacy, publicity, or other rights
- Contains obscene, sexually explicit, violent, extremist, discriminatory, or harmful content
- Promotes illegal activities, fraud, scams, or unauthorised financial schemes
- Contains malware, spam, phishing, or harmful links
8. Packages and Payments
Some listings or services may require payment. Package features, prices, duration, and availability may change from time to time. Payment does not guarantee sales, clients, exhibitions, media coverage, ranking, or business results.
9. Refunds
Unless otherwise stated, listing fees and digital service fees are non-refundable once the listing is submitted, reviewed, approved, published, or service work has started. Refund requests may be reviewed at ArtTern’s sole discretion.
10. No Guarantee of Results
ArtTern does not guarantee artwork sales, gallery representation, event participation, followers, leads, media coverage, search ranking, or commercial success.
11. Third-Party Services
ArtTern may include links to third-party websites, payment providers, social media platforms, maps, ticketing services, galleries, and event organisers. We are not responsible for third-party content, availability, policies, actions, or services.
12. Limitation of Liability
To the maximum extent permitted by law, ArtTern and its owners, employees, contractors, and partners shall not be liable for any indirect, incidental, consequential, special, reputational, financial, or business loss arising from your use of the website or services.
13. Indemnity
You agree to indemnify and hold ArtTern harmless from any claims, damages, losses, liabilities, costs, or expenses arising from your content, your use of the website, your breach of these Terms, or your violation of any law or third-party rights.
14. Suspension and Termination
We may suspend or terminate access to the website, account, listing, or services at any time if we believe you have violated these Terms, submitted unlawful content, misused the platform, or created legal, reputational, or security risk.
